An Appeal Court sitting in Port Harcourt, Rivers State has fixed Thursday, October 28, to hear and rule on the motion for interim order of injunction brought by prince Uche Secondus against the PDP and others.
Secondus in the appeal marked CA/PH/ 339, is asking the court to restrain the PDP from conducting its National Convention slated for October 30 and 31, 2021.
The suspended chairman, through his Counsel, Payo Oyetubo, is asking the court to suspend the October, 30th and 31st National Convention of the party and grant him the right to preside over the convention.
When the case came up, six other members of PDP drew the attention of the court on their application for joinder which was not opposed by counsel to Secondus and was subsequently granted by the three man panel of the appeal court.
Counsel to the defendants opposed to the motion for Interim injunction by Secondus’ counsel seeking to stop the PDP forthcoming National Convention, asked for time to respond to the process.
The three-man appeal panel led by Justice Haruna Simon Tsammani after listening to the argument from the parties, ordered counsel to the plaintiff to serve the process on the defendant’s Counsel within 24 hours.
Justice Tsammani also urged respondents’ counsels to respond within 24 hours and adjourned till 28th of October, for hearing and possible ruling on the motion.
