A lawyer, Komak Fwang’an, has accused the Plateau State Independent Electoral Commission (PLASIEC) of disobeying a tribunal order reinstating his client as the All Progressives Congress (APC) winner of the councillorship seat for Angwan Rogo/Rimi Ward in Jos North Local Government Area.
Fwang’an disclosed this in a petition he addressed to the Attorney General and Commissioner of Justice in Plateau State over the alleged failure of the to comply with court orders.
The Plateau State Appeal Tribunal had on June 16 upheld the election of Nasiru Aliyu Haruna as the All Progressives Congress (APC) winner of the councillorship seat for Angwan Rogo/Rimi Ward in Jos North Local Government Area.
Fwang’an argued that the state attorney general, as the chief law officer, is in a good position to give appropriate advice to PLASIEC “and the authorities concerned to comply with the order of the appeal tribunal by issuing a certificate of return to Nasiru Aliyu Haruna as ordered immediately.”
The chairman of the tribunal, G.D. Fwomyon, in his judgment, has dismissed the cross appeals by Tanim Muhd Suleiman seeking to uphold the verdict of the election tribunal of April 20 and held that he was not duly elected and returned as the councilor.
“The petitioner (Haruna) is declared validly elected or returned having been the sole candidate of the 2nd respondent (APC) and having met the requirement of the law,” the appeal tribunal chairman said.
