Court of Appeal reserves judgement in Kano emirate tussle

The Court of Appeal in Abuja has reserved judgment in the six appeals involving the emirship tussle in Kano State.

Justice Mohammed Mustapha who leads a three-member justices had on Wednesday, reserved the chieftaincy appeals for a date to be communicated after the lawyers argued their briefs before the court.

The lead counsel to the Kano State Government, Adegboyega Awomolo (SAN) and the state House of Assembly, Okechukwu Edeze (SAN) told the appellate court to allow the appeals, but respondent counsel P.H. Ogbole (SAN) objected and asked the court to dismiss them.

The panel also struck out Also, the three motions brought by Alhaji Aminu Baba Dan Agundi was rejected by the justices who said the matters lack merit, and being an attempt to amend his appellant briefs and awarded N500,000 against him in each, making it N1.5 million.

The appeals before the appellate court are Alhaji Aminu Ado Bayero vs Attorney General of Kano State and 10 others in appeal number CA/KN/166/M/2014 and appeal number CA/KN/126/M/2024 on appointment of emir between Kano State House of Assembly and another vs Alhaji Aminu Babba Dan Agundi and 6 others.

Justice Abdullahi Liman, of the Federal High Court in Kano had nullified the deposition of Emir Ado Bayero and appointed Muhammadu Sanusi II on May 23by Governor Abba Yusuf’s action of deposing Emir Ado Bayero.

The court also held as “null and void” the Kano Emirate Council (Repeal) Bill, 2024 passed by the Kano State House of Assembly, which voided Bayero’s seat.

Liman said, “The above action violates the order of this court earlier stated,” adding that “The balance of convenience is on the applicant herein (Alhaji Aminu Babba Dan Agundi) herein.”

There was as another Kano State High Court barred Ado Bayero from parading himself as emir.
