Amber Heard is in court again today, to appeal the judgement against ex-husband, Johnny Depp
The 36-year-old actress reportedly filed the appeal earlier this month, claiming that the previous trial was unfair since therapy documents in which she was allegedly assaulted were excluded.
The evidence was previously deemed hearsay by Fairfax County, Virginia, Judge Penney Azcarate.
Heard’s attorneys said in the 68-page petition that “the trial court wrongfully precluded the jury from considering multiple distinct instances in which Heard reported Depp’s abuse to a medical expert.”
“If not reversed, the trial court’s exclusion of contemporaneous reports of domestic violence to medical professionals will make it harder for other abuse victims to substantiate charges of abuse, and they are probably going to be discouraged from coming forward,” they continued.
In response to the United Kingdom High Court of Justice’s decision in a separate defamation suit brought by Depp, which found the actor guilty of abusing his ex-wife on many occasions, Heard’s attorneys wrote that the case should never have gone to trial.
After arguing that his ex-op-ed wife’s in the Washington Post, in which she claimed to have experienced domestic abuse, was defamatory, Depp won a $10.35 million judgment in June 2022.
Despite winning the majority of the charges at trial, the actor was required to give his wife $2 million after the trial and the one count of defamation he was found guilty of.
The charge stems from a claim made by Adam Waldman, one of Depp’s attorneys, that Heard and her pals wrecked her flat and lied about it. a statement that was later proven to be untrue.
Depp appealed this month, saying that the one defamation claim that Heard had prevailed on at trial was “erroneous.” He claimed that he shouldn’t be held responsible for his attorney’s remarks.
A panel of judges will now evaluate the merits of both appeals in accordance with Virginia law.
Depending on the outcome and who is left disappointed, Heard and Depp have the option of taking the issue to the Commonwealth’s Supreme Court.
It is the pair’s third appearance in court: A UK court made the winning decision first, then a US court made the winning decision for Heard.
