The Supreme Court on Wednesday nullified the nomination of Senator Emmanuel Bwacha as the All Progressives Congress (APC) governorship candidate in Taraba State.
In a judgment on Wednesday, a five-member panel led by Justice Kudirat Kekere-Ekun affirmed the verdict of the Federal High Court which held that the APC did not conduct any valid governorship primary in the state.
The Federal High Court Jalingo in September 2022 nullified the governorship primaries that produced Senator Bwacha as the APC candidate.
One of the aspirants, David Sabo Kente, had filed the suit against Bwacha’s candidature.
The presiding judge, Simon Amobeda, had agreed with Mr Kente that no governorship primary was held in Taraba.
The judge ordered that a fresh primary should be conducted within 14 days.
On November 24, the Court of Appeal sitting in Yola set aside the judgment of the trial court which sacked Bwacha.
But Mr Kente, through his counsel, Kanu Agabi (SAN0, filed an appeal before the Supreme Court.
In its judgment, the apex court held that the court of appeal was wrong to have set aside the decision of the trial court.
The Supreme Court, however, allowed the appeal setting aside the judgment of the Court of Appeal.
